1. Who you're agreeing with

These terms are an agreement between you and Light Chop LLC, a New Mexico limited liability company based in Albuquerque, New Mexico ("Light Chop", "we", "us"), which operates GYST (the iPhone app and getgystapp.com, together "GYST"). By creating an account or using GYST you agree to these terms and to our Privacy Policy. If you don't agree, don't use GYST.

2. Who can use GYST

• You must be at least 16 years old.
• GYST is offered for use in the United States.
• One person per account. Give accurate information and keep it current.
• You can't use GYST if the law forbids you from doing so, or if we've previously ended your account for breaking these terms.

3. Your account

• Keep your password and devices secure. You're responsible for what happens under your account.
• Money features require an extra check (a passkey or an emailed code). You can turn on Protect your GYST to require one to open the app.
• Tell us right away at [email protected] if you think someone else has used your account.
• If we reasonably believe an account is compromised or being misused, we may limit it while we look into it, and we'll tell you unless the law or security stops us.

4. Your content

• You own what you put into GYST: your events, tasks, lists, notes, habits and everything else ("your content").
• You give us permission to store, copy, process and display your content only as needed to run GYST for you, including sending it to the services you turn on (as the Privacy Policy describes), and to share it with the people you choose. This permission ends when you delete the content or your account, except for copies in short-lived backups.
• When you share something with friends, family or list members, they can see it (and, if you allow, change it) in their own GYST. Only share what you have the right to share, including other people's information.

5. Acceptable use

Don't use GYST to:

• break the law or anyone's rights, or harass, threaten or harm anyone;
• store or share content you don't have the right to use;
• access other people's accounts or data, or get around security or usage limits;
• scrape, copy or resell GYST, or use it to build a competing product;
• reverse engineer GYST, except where the law allows it despite this term;
• overload or disrupt GYST, or send malware or automated traffic beyond what an authorized connected assistant does for you.

6. AI features

• GYST's AI features use outside AI companies. AI answers can be wrong, incomplete or out of date. Check anything important, especially events it creates or changes.
• If you add your own API key, you have your own agreement with that company, and you pay for what you use. We aren't responsible for their outages, charges or outputs.
• When you have no key, AI chat may use our backup provider. We may limit or change the backup at any time.

7. AI assistants you connect

You can connect outside AI assistants to your account and choose what they can see and change. They act on your behalf, so you're responsible for what they do with the access you give them. You can disconnect any assistant at any time in Profile → Security. The assistant's own company's terms apply to that assistant.

8. Health

GYST can show data from Apple Health and help you build habits. GYST is not a medical device and doesn't give medical advice, diagnosis or treatment. Sleep scores, insights and habit tracking are for general wellness only. Talk to a qualified professional about any health question, and never delay getting care because of something in GYST.

9. Money

• GYST's Money features show information from accounts you link through Plaid and details you enter, for your personal use. Light Chop is not a bank, broker, lender or financial, investment, tax or legal adviser, and nothing in GYST is advice.
• Balances and transactions come from outside providers and may be delayed, incomplete or unavailable.
• Figures GYST calculates (budgets, recurring bills, payday and cash projections, loan balances) are estimates and may be wrong.
• Automatic asset values from RentCast and VinAudit are estimates, not appraisals. Stock quotes from Twelve Data may be delayed and aren't for trading.
• Before linking a bank you'll be asked to agree to how GYST handles bank data. When that changes in a way that matters, we'll ask you to agree again.

10. Other companies' services

GYST works with services run by other companies, including Apple, Google, Plaid, AI providers, and the assistants you connect. Their terms and privacy policies apply to your use of them. We aren't responsible for those services, and we may stop supporting any of them.

11. Paid features

GYST is currently free. If we offer paid features, we'll describe the price and terms before you buy. Purchases in the iPhone app are billed by Apple, and you manage or cancel subscriptions in your Apple account settings. Apple's refund policies apply to those purchases.

12. Ending your account

• You can leave any time by deleting your account in Profile → Delete Account. That permanently deletes your data as the Privacy Policy describes, including lists you own that you've shared with others.
• We may suspend or end your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering GYST. Unless it's unsafe or unlawful, we'll give you notice and a chance to export your data first.
• Sections 4 (the part about content already shared), 9, 13, 14 and 15 continue after your account ends.

13. Disclaimers

We work hard to keep GYST reliable, but GYST is provided "as is" and "as available." To the fullest extent the law allows, Light Chop disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and doesn't promise that GYST will be uninterrupted, error-free or secure, that reminders will always arrive on time, or that data will never be lost. Keep your own copy of anything you can't afford to lose (Profile → Import & Export).

14. Limits on liability

To the fullest extent the law allows:

• Light Chop and its members, employees and agents won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from GYST or these terms, even if we were told they were possible.
• Our total liability for all claims about GYST or these terms is limited to the greater of the amount you paid us for GYST in the 12 months before the claim, or US$100.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits liability that can't be limited by law.

You agree to cover Light Chop's reasonable costs from claims by others caused by your content or your breaking these terms.

15. Governing law and disputes

These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute that isn't resolved informally will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you and Light Chop agree to those courts' jurisdiction. Before filing a claim, please email [email protected] so we can try to resolve it within 30 days.

16. Changes to these terms

We may update these terms. For significant changes, we'll tell you in the app and by email before they take effect, and ask you to accept the new version the next time you open GYST. If you don't accept, you can delete your account. Changes don't apply to disputes that arose before they took effect.

17. If you got GYST from the App Store

• These terms are between you and Light Chop only, not Apple. Light Chop, not Apple, is responsible for GYST and its content.
• Your license to use the iPhone app is a limited, non-transferable license to use it on Apple devices you own or control, as allowed by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for GYST.
• If GYST fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for GYST.
• Light Chop, not Apple, is responsible for any claims about GYST, including product liability, legal or regulatory compliance, consumer-protection, privacy, or intellectual-property claims.
• You confirm you're not located in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. General

These terms, the Privacy Policy and any feature-specific terms you agree to in the app are the whole agreement between you and Light Chop about GYST. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You can't transfer these terms without our consent; we may transfer them as part of a merger or sale of our business.
